Sport Connect Terms of Service

Introduction

Sport Connect is an industry wide platform designed to digitally connect the Australian sport and physical activity industry – individuals, organisations and technology suppliers and developers.

Sport Connect, part of the Australian Government’s Sport 2030 plan, helps provide a seamless experience to Australians when digitally engaging with sport and physical activity, as well as making it easier for sport and physical activity organisations (and their technology partners) to deliver that experience.

Sport Connect is provided by the Australian Sports Commission (‘ASC’, ‘we’ or ‘us’ in these terms).

Your use of Sport Connect

By signing into Sport Connect, you agree to be bound by these terms of use (Terms) whenever you use Sport Connect.

We may update these Terms from time to time. When the Terms are updated, you will need to agree to the updated version before continuing to use Sport Connect.

Third Party Service terms of use

Third Parties (such as sport organisations and technology partners) that you interact with through Sport Connect may have their own terms of use. Such terms are between you and the Third Party and do not involve the ASC.

Your personal devices

When you use Sport Connect, you may be asked for your permission to access certain hardware or software features of your mobile, tablet, computer or other device (Devices), for example, your camera.

Access to features on your Device is only for the purpose of being able to assist you with a particular service. For example, being able to use the camera on a mobile phone to recognise a QR code.

Rights we grant you

We give you permission (in the form of a worldwide, non-transferable, non-exclusive, revocable licence) to use the Sport Connect service on your Devices, so long as you comply with these Terms and any other applicable laws.

Privacy and your personal information

By signing into Sport Connect, you agree to the ASC’s collection, use and disclosure of your personal information as set out in the [Privacy Notice].

Communications to you

ASC may send you communications for the purpose of providing services to you through Sport Connect.

Third Party Services that you sign up to through Sport Connect may send you communications related to your involvement with that Third Party, including marketing material as well as membership and participation information.

Your responsibilities

In using Sport Connect, you must comply with your responsibilities as set out in this section. If you do not comply with these responsibilities, we may suspend or terminate your access to Sport Connect.

Provide correct and up to date information to Sport Connect

You are responsible for making sure your personal details (such as your name, contact details etc.) are correct and up to date in Sport Connect. If your details change, you should sign-in to Sport Connect and update your details.

Keep Third Party Services up to date

You are responsible for making sure your personal details (such as your name, contact details etc.) are correct and up to date with any third party sport organisation or technology partner (Third Party Services) that you may interact with through Sport Connect.

Updating your personal information in Sport Connect does not mean that Third Party Services connected to your Sport Connect account will be told about your updates, or that their records have been changed.

Keep your Sport Connect account safe

You are responsible for your Sport Connect account and making sure unauthorised users cannot access it.

You must not allow someone else to sign-in or use your Sport Connect account. You must keep your Sport Connect access details safe. Do not share these details with anyone else. If you do not take reasonable precautions to keep your Sport Connect details safe and someone is able to sign into your account, or if you give someone your details so that they can sign into your account, you are responsible for everything that person does with your account.

Things you are not allowed to use Sport Connect for

You are not allowed to use Sport Connect:

  • to participate in any illegal or fraudulent activity
  • to cause disruption to Sport Connect or to introduce any viruses or harmful code into Sport Connect or any Third Party Service
  • in a way that infringes another person's rights or prevents them from using Sport Connect
  • in any way that may harass, cause distress or inconvenience others
  • for unlawful, defamatory, offensive or scandalous purposes, or
  • in a way that encourages others to break the law.

You are not allowed to use any software (like bots, scraper tools etc.) to access, monitor or copy Sport Connect or its contents unless we have given you written permission in advance.

When your access can be taken away

If you do not comply with these Terms, or we suspect that to be the case, we may suspend or terminate your access to Sport Connect.

If the ASC chooses to discontinue Sport Connect then your access will be removed.

What we are responsible for

We are responsible for:

  • taking reasonable steps to ensure the security of your personal information while it is being collected by, stored or passing through Sport Connect
  • taking reasonable steps to ensure the links from Sport Connect to Third Party Services are secure, and
  • handling your personal information in accordance with applicable privacy laws and our Privacy Policy.

What we are not responsible for

We are not responsible for:

  • making sure Sport Connect is always available, works as intended or is free from viruses and harmful code
  • fixing any defects with Sport Connect
  • ensuring the functionality of Sport Connect does not change
  • any liability, loss, damage, cost or expense whatsoever as a result of your use, or your inability to use, Sport Connect or any Third Party Service, and
  • any Third Party Service accessed through Sport Connect, including the security and handling of your personal information by Third Parties.

The ASC provides you with access to Sport Connect on an 'as is' basis and use is at your risk. To the maximum extent permitted by law, the ASC does not give any representation or warranty of any kind, whether express, implied, statutory or otherwise in respect to the availability, currency, completeness, quality or reliability of Sport Connect or that it will be fit for any particular purpose or will not infringe any third party rights including intellectual property rights.

Liability and release

To the extent permitted by law, you release the ASC from all liability, loss, damage, cost or expense (including indirect and consequential loss and damage) suffered by you, or any other person, however arising including due to the use of, or reliance on, Sport Connect, any inability to access Sport Connect or any damage to your Devices or loss of Data.

Sport Connect is made available to you on the understanding that you will exercise your own skill and care with respect to its use.

The ASC does not endorse any Third Party Services and links to such Services do not constitute endorsement of those Third Parties or Third Party Services, or any associated organisation, product or service.

Intellectual Property Rights

All copyright, trade marks and other intellectual property rights subsisting in Sport Connect are owned by the ASC, the Commonwealth or Third Parties, and are protected by the laws of Australia.

Applicable law

The laws of the Australian Capital Territory, Australia (ACT) apply to these Terms.
